The Requirements for expunction are found in Chapter 55 of the Texas Code of Criminal Procedure. Like most criminal procedure, the Texas Statute for Expunction of Criminal Records can be difficult for laymen to understand. The statute spells out who has the right to expunction, the procedure for expunction and the effect of expunction among other things. Eligibility for Expungement in Texas

In Texas, expungement is available to who have been arrested but the case did not lead to a finding of guilt. It is also available to those who have successfully completed deferred adjudication for a Class C misdemeanor or who plead guilty to a Class C misdemeanor alcohol crime. It is not available to those who have been convicted of a felony in the five (5) years prior to the arrest.

Effect of Expungement in Texas

If you successfully obtain an expunction order, any person or agency in possession of records of your arrest and any subsequent prosecution must destroy them. An expunction order compels the Texas Department of Public Safety (DPS) to stop reporting details of your case, and the information will no longer be attainable by anyone receiving records from the DPS database. Your record will not show up on a background check, and you can deny the arrest every happened unless you are questioned under oath in a proceeding related to the expunged arrest.
